TERMS & CONDITIONS
These Terms and Conditions shall apply to all current and future Products provided to the Customer via Evolution Fires UAE (the “Website”).
This Website is owned by RJC INTERNATIONAL FURNITURE TRADING L.L.C, a company registered with the Dubai Economy and Tourism under license number 1353638, having its registered address located at office Al Qusais Industrial Third, Dubai, United Arab Emirates (hereinafter referred to as the “Company”).
Please read these Terms & Conditions carefully before accessing or using our Website. By accessing or using any part of the Website, you agree to be bound by these Terms & Conditions. If you do not agree to all the Terms & Conditions, then you may not access the Website or use any services.
By visiting our Website and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms & Conditions “Terms & Conditions”), including those additional policies referenced herein and/or available by hyperlink. These Terms & Conditions apply to all users of the Website, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
These Terms and Conditions may be changed from time to time without prior notice. Changes shall be posted on this page and the Customer’s use of the Website after such changes have been posted shall constitute the agreement to the modified Terms and Conditions and all of the changes.
By accessing or using any part of the Website, you agree to be bound by these Terms and Conditions. If you do not agree to all the Terms and Conditions, then you may not access the Website or use any Services. Our store is hosted on Shopify. They provide us with the online e-commerce platform that allows us to sell our Products and Services to you.
1. DEFINITIONS AND INTERPRETATIONS
1.1. “AED” means the currency of the United Arab Emirates.
1.2. “Customer” means anyone who accesses or uses our Website and/or purchases and/or wishes to purchase the Products and/or has been or will be provided with the Products by the Company whether a person, Company, firm or corporate body together with any subsidiary or entity.
1.3. “Price” means the price of the Products displayed on the Website.
1.4. “Product” or “Products” mean any product sold by the Company to a Customer.
1.5. “Terms & Conditions” or “T&C’s” mean these Terms & Conditions as they may be amended from time to time at the Company’s sole discretion.
1.6. “UAE” means United Arab Emirates.
1.7. “VAT” means Value Added Tax.
1.8. “Warranty Period” has the meaning assigned to it in section 12.2.
2. PRODUCTS & PAYMENT
2.1. The Company hereby agrees to provide its Products described on the Website to the Customer in accordance with these Terms and Conditions.
2.2. The Customer understands and acknowledges that Products are only sold through this e-commerce platform and the Company does not have a showroom in the UAE.
2.3. The price of Products shall be the Price displayed on the Website inclusive of VAT. The Company reserves the right to change the Prices of Products displayed at its sole discretion and in accordance with the applicable laws and regulations.
2.4. Unless provided otherwise, the Products shall be provided only upon receipt of payment by the Company. Payment can be made by:
2.3.1 Cash payment in AED (COD):
a. If you prefer to pay in cash rather than making an online payment on fireflydirect.ae, you can select the Cash on Delivery (COD) option shown at checkout.
Be aware that you must sign for your order upon delivery and present a valid passport or ID. Delivery will not be completed without a valid passport or ID at the time of delivery.
b. The Customer shall pay the exact order amount when the Product is delivered. The courier will not accept any other mode of payment like (non-cash) except cash during the delivery of the Product.
c. The Customer should check the Product condition for any tampering before accepting the order However, Customers are not allowed to open the order until payment has been handed over to the courier partner.

2.3.2 Card payment in AED.
2.5. The Customer undertakes that the Company may assign part or all of the provision of the Products to third parties on behalf of the Company without any liability on the part of the Company.
2.6. We have made every effort to display as accurately as possible the colors and images of our Products that appear on the Website. We cannot guarantee that your computer monitor's display of any color will be accurate.
2.7. All orders placed on our Website constitute an offer from you to purchase and are subject to acceptance and Product availability. Your order will be considered accepted only when the Product has been dispatched.
2.8. RJC International Furniture Trading CO LLC reserves the right, at its sole discretion, to refuse or cancel any order for a Product at any time before dispatch, for any reason. We also reserve the right to refuse Service to anyone at any time, for any reason.
2.9. Our stock is subject to change dynamically. If any Product(s) you have ordered are unavailable for any reason, you will be notified via email or phone, and an estimated availability date will be provided. You will have the option to agree to the new available date or cancel the order at this time.
3. WEBSITE COUPONS
3.1. Coupon codes can only be used once per order.
3.2. Coupons may have specific eligibility criteria, such as specific Products, or categories.
4. VALIDITY
4.1. By placing an order, the Customer expressly agrees to the applicability of the Terms and Conditions of sale, delivery and assembly and waives the applicability of his/her/its own deviating general terms and conditions or terms and conditions of purchase and payment. No other terms and conditions shall apply, even if such terms and conditions are not expressly excluded by us in a specific case. If the Customer does not agree thereto, he/she/it must refrain from placing an order.
5. ORDER CANCELLATION
5.1. The Company reserves the right to cancel an order should the ordered Product be out of stock.
5.2. Orders may be cancelled before processing by sending an email to sales@evolutionfires.ae.
5.3. If you cancel your order and the Product has already shipped out of our warehouse the Return policy applies even if the item is still with the courier as we still get charged for this service. Please see section 9.
5.4. We may cancel your order(s) if you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the Products; or you do not, allow us to deliver the Products to you.
5.5. In the event of card payment, refunds shall be processed within Ten (10) working days from the date of cancellation. We reserve the right to determine the appropriate refund method.
6. DELIVERY
6.1. Orders are processed within 1-2 business days from the date of placing the order.
6.2. Once your order is dispatched, you will receive a confirmation email with tracking details.
6.3. Our Products are shipped free of charge across the UAE. We do not offer international shipping at this time; you will be notified by email in the event that we offer international shipping at any future date.
6.4. To be able to deliver the Products to the correct address and recipient, a valid address, email address and contact number must be provided at checkout.
6.5. Delivery shall be within 3-7 days from the date of placing the order. Delivery will be made between 9 am and 5 pm, Monday to Saturday.
6.6. If the recipient is unavailable at the time of delivery, the delivery company will notify you by email, text or WhatsApp to schedule a re-delivery attempt.
6.7. If the Products are not available for delivery by the estimated delivery date for any reason, the Company reserves the right to delay delivery for a reasonable time. We will contact you by email to confirm the new delivery date. If this new delivery date is not acceptable, you will have the option to cancel the order and receive a full refund in accordance with these Terms and Conditions.
6.8. We shall not be liable for impossibility of delivery or for delays in delivery insofar as they have been caused by force majeure or by other events that were unforeseeable at the time of placing the order (e.g. any disruptions of operations, delays in transport, pandemics, strikes, lawful lockouts, shortages in labour, energy, weather conditions or raw materials, difficulties in procuring the necessary official licences, official measures or the non-delivery, incorrect or late delivery by the supplier) and for which we are not responsible. If such events make it considerably difficult or impossible for us to carry out the delivery or service and if the obstacles are not just of a temporary duration, we are entitled to cancel the order. In the event of obstacles of a temporary duration, the times of delivery and performance shall be extended or said times shall be postponed by the time period of the obstacle plus an appropriate lead time. Insofar as the Customer cannot be expected to accept the delivery due to the delay, he/she may cancel the order by immediately informing us in writing by email to sales@evolutionfires.ae
6.9. If the Customer fails to take delivery of the Products at the time of delivery, the Customer shall provide the Company with reasonable justification as to the reason for his/her/its refusal to accept the Product. The Company shall store the Product for a period of Seven (7) days, then, shall have the right to re-sell the Product to another person or entity. Refunds shall be processed in accordance with section 9.
6.10. We do not offer installation or assembly services at this time. You can contact us via email to sales@evolutionfires.ae or phone to 058 515 4226 for any guidance. We strongly advise not to book any tradesmen/handyman to install your Product until you have received all parts of your Product in your home. We will not be liable for any costs that occurred due to booking in the tradesman/handyman prior to receiving your Product.
6.11. Once the Product is delivered to the address specified by the Customer, the Customer shall place his/her signature on the confirmation of receipt document.

7. RISK
7.1. Risk shall pass to the Customer upon delivery of the Product to the specified address. Without prejudice to the warranties available, The Company shall not be liable in the event that the Product perishes following its delivery to the Customer.
8. TITLE
8.1. Subject to payment of the Price as set out in section 2, title in the Product shall pass to the Customer upon delivery.
9. RETURNS AND REFUNDS
9.1. Although we strive to keep our Customers pleased with our Products, events may occur where the Customers are not 100% satisfied with their purchase and wish to return the Product(s). Customers may request a refund within thirty (30) days from the delivery date of the Product(s).
9.2. Any exchange, return and refund requests shall be submitted in writing to sales@evolutionfires.ae. No oral exchanges will be valid. Any request must be supported with the purchase order/proof of payment and receipt.
9.3. Refunds shall be processed once the item has been returned to our facility and examined, see 9.4.
9.4. Upon return of the Product to the Company, the Company shall have the right to examine the Product and assess its condition. In any case, the Company shall update the Customer within Fifteen (15) days as to the result of the assessment.
9.5. If you would like to return your Product,
• The Product must be in its original packaging.
• The Product should not have been opened or repackaged.
• The Product should not have been installed or used.
9.6. While Evolution Fires UAE includes free shipping on specific Products at no extra charge, you are responsible for the original delivery cost and return shipping costs tied to the return of the Product back to Evolution Fires UAE. The return charge will cover the original delivery cost and the return cost, which will be AED 400. This amount will be deducted from your refund.
9.7. If your returned Product is found to be missing parts or exhibits damage, this includes packaging damage if opened, the corresponding value of these components will be subtracted from your refund amount. This section is established to ensure that returned Products are in the same condition as when originally purchased and to fairly account for any missing or damaged components. Signs of damage to the box caused by delivery will not be deducted from your refund.
9.8. Refund Method.
9.8.1 For card payment refunds, the refund will be processed ten (10) working days after we receive the Product back and the quality control check has been done.
9.8.2 For cash payment refunds, we will issue your refund via bank transfer. We will contact you by email once the Product has been quality control checked asking for your bank details. The refund will be processed ten (10) working days after receipt of your bank details. We shall not be held responsible for any inaccuracies in the bank details provided.
10. NOTIFICATION OF DEFECTS
10.1. The Customer's claims for defects require that he/she/it has duly complied with his/her/its statutory obligations to check the delivered Products and to provide notification of defects. Notification of defects must be submitted in writing to sales@evolutionfires.ae immediately upon discovery of the defect. Delay in notification may worsen the condition of the Product(s) and the Customer will be held responsible in the case it is found that the current condition of the Product(s) is a result of the Customer’s delay in notifying us.
10.2. In the event of a defect in the Product, the provisions of section 12 (Warranties) shall apply.
11. MODIFICATIONS TO THE SERVICE AND PRICES
11.1. Prices for our Products are subject to change without notice.
11.2. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
11.3. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
11.4. We make every effort to provide accurate pricing and Product information on this Website; however, errors, including pricing or typographical errors, may occur. In the event that a Product is listed with incorrect pricing or inaccurate details, we reserve the right to correct such errors and take appropriate action, including cancelling orders placed for the affected Product.
12. WARRANTIES
12.1. Please note that the removal of the plug top will invalidate your warranty.
12.2. The authorized agents of the Company shall free of charge (subject to providing the Company with the purchase receipt or delivery note) repair, or at its option, replace defective Products, where the defects appear under proper use within five (5) years from the date of delivery (the “Warranty Period”), provided that:
(a) Subject to section 10.1, notice in writing of the defects complained of shall be given to the Company immediately upon the date of their appearance, and
(b) after thorough investigation, such defects shall be found to the Company’s reasonable satisfaction to have arisen solely from the Company’s faulty design, workmanship or materials.
12.3. Any repaired or replaced Products shall be redelivered by the Company free of charge to the original point of delivery. Any parts of the Product that have been replaced shall become the property of the Company.
12.4. The Customer acknowledges that any work of repair or replacement carried out by the Company shall not renew or extend the Warranty Period.
12.5. This Warranties section shall be subject to and without prejudice to any consumer rights granted under the applicable laws of the United Arab Emirates.
12.6. The warranty is only valid from an authorized stockist.
12.7. The Warranty is non transferable and must remain with the original purchaser.
12.8. For all Warranty claims, a valid proof of purchase is required.
12.9. The Company reserves the right to reject a repair/replacement request or charge the Customer for such repair/replacement where the defect is due to non-compliance with the installation and/or servicing instructions or misuse of the Product. The Company shall assess the defect and provide the Customer with feedback within Fifteen (15) days from the date of the repair/replacement request.
12.10. The Company shall not bear the cost or reimburse the costs of any third party who carries out any repair/replacement of the Product or fits parts at the request of the Customer, unless the Customer obtains the prior written consent of the Company.
12.11. Replacement of either parts of the Product or the whole Product shall be subject to assessment of the Product’s viability by the Company, at its sole discretion. If any part is no longer available (e.g. particular colour variations), we will replace it with a functional replacement part.
12.12. The warranty covers:
a) Lights
b) Heater Element
c) Main Board
d) Circuit Board
e) Flame rod and Motor
12.13. This warranty does not cover:
a) Normal wear and tear, including parts that might wear out over time e.g. fuses and batteries
b) Woodwork
c) Glass
d) Fuel bed items (logs, crystals, slate)
e) Damage caused by faulty installation, theft, tampering, neglect, misuse, accident, fire, flood, explosion, lightning, storms, frost or other bad weather conditions.
f) Accidental damage
g) The damage was caused by the non-observance of the manufacturer’s installation instructions.
h) Damage from external sources such as transit, weather, electrical outages or power surges.
i) Any unauthorized adjustments made to the product by a third party.
j) Servicing and its associated costs.
k) Self-maintenance tasks such as cleaning.
l) Failures caused by circumstances outside of our control.
m) Negligent use, misuse, neglect or careless operation of the product
n) Use of the Product which is not in accordance with our user manual
o) Use of parts and accessories which are not our genuine components.
13. USER MANUAL
13.1. When using electrical appliances, basic precautions should always be followed to reduce the risk of fire, electric shock and injury to people, including the following:
a) Read and understand the entire owner’s manual, including all safety information, before plugging in or using the product. Failure to do so could result in fire, electric shock, or serious personal injury.
b) The heater is hot when in use or has been used. To avoid burning, do not touch the hot surface. If provided, use handles when moving this heater. Keep combustible materials, such as furniture, pillows, bedding, papers, clothes, and curtains, at least 1m from the front of the heater and keep them away from the sides and rear. In order to avoid overheating, do not cover the heater.
c) Extreme caution is necessary when any heater is used near children or the infirm and whenever the heater is left operating and unattended.
d) Always unplug the heater when not in use.
e) Do not operate any heater with a damaged cord or plug or after the heater malfunctions, has been dropped damaged in any manner, return the heater for examination, electrical or mechanical adjustment, or repair.
f) Indoor use only, do not use outdoors.
g) The heater is not intended for use in bathrooms, laundry areas and similar indoor locations. Never locate the heater where it may fall into a bathtub or other water containers.
h) Do not run cord under carpeting. Do not cover the cord with throw rugs, runners, or similar coverings. Arrange the cord away from traffic area and where it will not be tipped over.
i) To disconnect the heater, turn the controls off, then remove the plug from the outlet.
j) Do not insert or allow foreign objects to enter any ventilation or exhaust opening, as this may cause an electric shock or fire or damage the heater.
k) To prevent a possible fire, do not block air intakes or exhaust in any manner. Do not use on soft surfaces, like a bed, where openings many become blocked.
l) A heater has hot and arcing or sparking parts inside. Do not use it in areas where gasoline or flammable liquids are used or stored.
m) Use this heater only as described in the manual. Any other use not recommended by the manufacturer may cause fire, electric shock, or injury to persons.
n) High temperatures may be generated under certain abnormal conditions. Do not partially or fully cover or obstruct the front of this heater.
o) Replacement of the lamps should be done only while the heater is disconnected from the supply circuit.
p) This appliance is not intended for use by persons (including children) with reduced physical, sensory or capabilities or lack of experience and knowledge, unless they have been given supervision or instruction concerning the use of the appliance by a person responsible for their safety.
q) Children should be supervised to ensure that they do not play with the appliance.
r) CAUTION: In order to avoid a hazard due to inadvertent resetting of the thermal cut-out, this appliance must not be supplied through an external switching device, such as a timer, or connected to a circuit that is regularly switched on and off by the utility.
s) Electric sockets in residential rooms should comply with the 6/12 spacing requirements; this comes from the NEC and states that in a living area of a home, you must keep an electrical socket (outlet) 6 feet from any obstruction or break in the wall, such as a doorway and no more than 12 feet from the previous electrical socket.
t) Whilst electric fires are very safe, we recommend you only plug into a mains socket; do not use an extension lead as the extension lead wire can get knocked or overheat and become a hazard.
u) Some products include a GLASS panel! Always use extreme caution when handling glass. Failure to do so could result in personal injury or property damage.
v) Select a suitable location that is not susceptible to moisture and is away from drapes, curtains, furniture and high-traffic areas.
w) Check the fire is working before installing
x) Do not remove the plug from the appliance this will cancel your warranty
14. INTELLECTUAL PROPERTY
14.1. The Company exclusively owns all intellectual property rights pertaining to its the Products, and any related business assets, including software, documents, logos, and designs. The Client is strictly prohibited from using, modifying, copying, reproducing, or exploiting any of the Company’s intellectual property without prior written consent. This obligation to respect and protect the Company’s intellectual property remains in effect. The Customer is also responsible for informing the Company of any potential or actual infringements of these rights.

15.1. Certain ads, content, products and services available via our Website may include third-party links.
15.2. Third-party links on this Website may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
15.3. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

17. ERRORS, INACCURACIES AND OMISSIONS
17.1. Occasionally there may be information on our Website or in the Service that contains typographical errors, inaccuracies or omissions that may relate to Product descriptions, pricing, promotions, offers, Product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

19. INDEMNIFICATION
19.1. The Customer shall at all times hereafter indemnify and keep indemnified the Company against all actions, suits, proceedings, claims, demands, costs, charges, expenses and consequences whatsoever which may be taken or instituted against the Company or which may be incurred or become payable by the Company by reason of or on account of the following:
a) The Company’s failure to provide Products for a reason beyond of its control as; and
b) Breach by the Customer of his/her/its obligations towards third parties.
20. WHOLE AGREEMENT
20.1. The Customer acknowledges that these Terms and Conditions contain the whole Agreement between the Company and the Customer. Any oral representations are specifically excluded unless the same are agreed in writing between the Company and the Customer.
21. SEVERABILITY
21.1. Each provision of these Terms and Conditions is severable and distinct from the others and if any provision is, or at any time becomes, to any extent or in any circumstances invalid, illegal or unenforceable for any reason that provision shall to that extent be deemed not to form part of these Terms and Conditions but the validity, legality, and enforceability of the remaining parts of these Terms and Conditions shall not be thereby affected or impaired, and every provision of these Terms and Conditions shall be and remain valid and enforceable to the fullest extent permitted by the laws of the United Arab Emirates.
22. WAIVER
22.1. The failure by either party to enforce at any time or for any period any one or more of the Terms and Conditions herein shall not be a waiver of them or of the right at any time subsequently to enforce all Terms and Conditions.
23. LIMITATION OF LIABILITY
23.1. Under no circumstances shall RJC International Trading Co LLC, including its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, but is not limited to, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether arising from contract, tort (including negligence), strict liability, or otherwise. Such liability extends to claims related to your use of the service or any Products purchased through the Website, including errors or omissions in content, or any loss or damage resulting from the use of the service or any content or product made available via the Website, even if we have been advised of the possibility of such damages to the maximum extent permitted by law.
24. GOVERNING AND APPLICABLE LAWS
24.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the UAE as applicable in the Emirate of Dubai. In the event of any dispute, the Company and the Customer shall first attempt to resolve the dispute amicably within Thirty (30) days of the date of the dispute. Should the parties to resolve the dispute amicably, the parties agree to refer the dispute to the jurisdiction of Dubai courts.
24.2. Individuals who choose to access this Website from outside the UAE are responsible for complying with the local laws and to the extent local laws are applicable.
